A gift from your Brother ………………...

So I got a 10ft Haulmark enclosed trailer from my brother.  The laws have changed and now he can "give" it to me with no sales tax.  But they did charge $15 to fill out the form that you both have to sign. It's something to keep in mind for the future.

 Yes. I am just full of anticipation waiting for her next budget.  I had some twinges of the old tarhole today and thought my piles were acting up but then I realised I was watching the news and her name came up.  guess I can save the Prep H for budget day.

They may not believe I bought it for a dollar, but I can prove he is my brother.  I thought of the dollar thing but I didn't want to getting into a pissing match so I spent the extra $14.87 and transferred it to me.

A couple years back a close friend of mine was giving his car to his brother and he tried the , my brother sold it to me for 1 dollar. They made him get the car appraised and he paid the tax on that amount. I don't know if the rules have changed since then.

   I'm not sure when the law changed.  I a few years ago my Father-in-law gave his daughter a car.  It seems now you can give something to your parents, brother or sister .  You both have to appear show photo ID  and sign the waver of sales tax.

 I don't think people should get carried away with this.  In my case it was a trailer he has owned for some years and with his eyesight, I don't think he would never use it.   If he ever needs it he can borrow it.  The idea is if I go over the border with it on the rear of my motorhome the ownerships all match.

How do I transfer ownership of a vehicle from a family member?

You can transfer ownership without paying the retail sales tax when receiving a vehicle from a:

  • spouse
  • parent or step-parent
  • grandparent or step-grandparent
  • son or step-son
  • daughter or step-daughter
  • grandson or step-grandson
  • granddaughter or step-granddaughter
  • son-in-law
  • daughter-in-law
  • father-in-law
  • mother-in-law
  • sibling
  • half siblings (siblings with a common parent)
  • adopted siblings (siblings with a common parent through adoption), or
  • siblings-in-law (siblings of a spouse or spouse of a sibling)

You will need to bring the following documents to a ServiceOntario centre:

Only one exempt transfer of the same vehicle, between family members, is allowed within a 12-month period.

 My Mom gave me her old daily driver beater about a dozen years ago and at the MTO I went to register it - I told her that my Mom gifted it to me. She explained that "there is a form to fill out and there is a fee attached.....unless you bought it from her, did you only pay a dollar for it?" I said "no, I didn't buy it, she just gave it to me". The girl shuffled some papers around and then asked me again if I only paid a dollar. Well, I must be a little slow but I did catch on eventually and paid my $0.13 tax, showed her the safety and drive clean, bought a sticker and was on my way!

But I digress, we're dealing with government stuff here and things change often, daily even. Throw in the fact that these kiosks are privately run now and you'll get different results from other locations and possibly from the same location with a different attendant - all of which just breeds more confusion.
