Fenderless Rod ...legal in Ont ?

There was a discussion over on HAMB about fenderless street rods and , of course , with 50 states having differing laws it became the usual confusing discussion when it came to legality . I'm a full-fendered fan but do like certain fenderless rods ....anybody know where legalities start and end here in Ontariario  biggrin ?

Legal-NO. Allowed, somewhat but you leave yourself at the mercy of the law. Legally, if the car was built with no fenders and was allowed to be sold for public road use, maybe. Safe, No, as following a vehicle with open wheels is haphazard at best. This topic is a can of worms most times because a firm Yes or No is never given. Even removing the fender on the front of a motorcycle is dangerous and illegal. Ask me how I know??? Being a licensed mechanic, I honestly would not sign a Safety Certificate for a fenderless streetrod. I like the look too, but we live in a suing society, so I would not assume responsibility for damages caused by no fenders. I asked a lawyer one time and he asked "Who took them off and Why???". Good question and I'll follow this thread and see if anyone has firsthand experience by owning such a car and being stopped by the police....Boots

I,m not sure about the laws but I do know ,If in the rain you will get pinched,,think roostertails..Maybe somebody knows way more than me,,and thats pretty likely,,Slim should know,,just sayin..

I believe that to be legal eagle, fenders are required, BUT, if you get a rodder friendly doing the safety, that it will pass. The cops are  pretty good about it unless driving in the rain, or you're being a dikhead.

any liability stemming from a lack of fenders on my rat truck is my insurance companies problem, the have my appraisal package and they are willing to insure it.

My understanding is, that it isnt really whether you have fenders or not. It is that you are responsible for what is thrown off of your tires. So, if you are driving in the rain throwing spray all over the guy behind you, you are in sh!t.

Poncho 62 has it correct. There is no law in Ontario requiring fenders but there is a law requiring fenders or a similar devise/shield etc. in the rain to stop rearward spray.

My only experience with a fenderless rod was a friend's '33 Ford ......he never got ticketed ( or pulled over ) and attempted to drive only on good weather days . Of course there were a couple of surprise downpours and he reported not only the rooster tail for vehicles behind him but the difficulty of his wipers handling the spray off the front tires . Not a pleasant situation . I've never cared for the look of cycle style fenders but I guess they would somewhat do the job in the rain .

Been driving mine for 4 years now and haven't been pulled over yet. I try to drive responsible and only on decent roads in good weather.
I'm a licensed mechanic too, the safety form says at the time of inspection this vehicle met all the minimum requirements.
What you do after the form is in your hand is up to you.

BC - Motor Vehicle Act, MOTOR VEHICLE ACT REGULATIONS

Mudguards
7.06 Every motor vehicle, trailer and semitrailer not constructed so that the spray and splash of water and mud to the rear of the vehicle is minimized shall be equipped with mudguards and, if necessary, mudflaps.

Alberta - ALBERTA REGULATION 322/2002 ,Traffic Safety Act, VEHICLE EQUIPMENT REGULATION
Mudguards.
64 The body of a motor vehicle or trailer or a fender, mudguard or similar structure must cover the width of the tire and extend to the mid‑point of the axle when viewed from behind the vehicle.

Saskatchewan -T-18.1 - Traffic Safety Act - V-2.1 REG 10 VEHICLE EQUIPMENT, 1987
Fenders or mudflaps
52(1) Subject to subsections (2) and (3), the vehicle shall have, for each tire, a fender, mudflap or body overhang that:
(a) reduces the rearward projection of gravel, mud, water and snow from the tire;
(b) is located so that the lowest point of the fender, mudflap or body overhang is above the ground a distance that is not greater than two thirds of the horizontal distance from that point to the centre of the wheel; and
(c) extends across the full width of the tire.
(2) The requirements of subsection (1) apply to wheels on steering axles only when the wheels are in the straight ahead position.
(3) Subsection (1) does not apply to a modified vintage vehicle when the vehicle is being operated on a dry, paved surface.

48 Every motor vehicle and every trailer, except a farm trailer, shall, when upon a highway, be equipped with splashguards or fenders adequate to reduce effectively the wheel spray or splash of water from the roadway to the rear thereof, unless adequate protection is afforded by the body of the motor vehicle or trailer or by a trailer drawn by the motor vehicle; and the splashguard shall comply with the standards prescribed therefor under the regulations.

I agree with parklane, if you're a dickhead behind the wheel, they'll look for everything to throw at you! Attitude is everything! All I ever got from cops were a thumbs up. I've only been pulled over once, because he thought it looked cool and wanted to check it out up close! The funny part ( besides me worrying while pulling over) was that while we were shooting the breeze, a couple of rice rockets with their fart exhaust tips went by and got on the throttle to show off/ provoke and it worked. The cop said " this is cool ride, I gotta go get rid of some sh!t off the streets" ran to his car, hit the lights and siren, smoked the tires doing a u turn and went after the "attitude".

 Was pulled over 2 summers ago but not ticketed. Was read the riot act and was told I must have fenders

and also a hood on the vehicle. When asked why ,I was told that if you blow a rad hose or overheat the water /anti freeze

would be dangerous to other driver and pedestrian's or anything else that can break under the hood.

I got caught in the rain out in London ,tried to wait it out and couldn't what a white knuckle ride home to mississauga

in the dark, only one wiper to boot. I have dent's in the backs of my mirrors where stones have been picked up by the

front tires and thrown hitting the mirrors.

All my rods from now on will be full fendered.

HaHa, Cat that was a a good one.I guess you are not only a hot rod god but a comidy god as well. If you are going to toss around challanges and insults, Cat ,I have one for you. I would love to see the certificate from a legit garage in say Port Perry or anyware other than your own garage for your build when its finished.Maybe even better would be a MTO cert that would prove once and for all that you are truely, the, hot rod god. Ed

so sorry slim but ed tends to call them as he sees them, I think those are pretty harsh words.  theres enough rattlin heaps that I question how they ever passed a cert so it would be only fitting to see a project being so hyped up pass a legit cert instead of being done at a 'buddies' place.  don't be a GOOF!

Back to Fender talk, I am the same as lightspeed Mike. I have never been pulled over and driven alongside trenton, and durham and our local police thru town side by side. If theres any rain, I pull over and only drive on paved roads where applicable.

Well you know how it goes in any compitition Dan .It is harder to repeat as champion than to win it the first time. Like Dave says you can still do it,if you work hard.Not really my sport. Ed

Now I know why I haven't laid any paint on the 31  it is Jmmy Shine all the way . It is not finished and I have never been stopped and like Lightspeed Mike I drive according to weather conditions and never on gravel roads. Not only that I have had motor head cops check the car out with a thumbs up. 033.JPG

WOW did this post get of track. I know 3 Ont. cops who have fenderless hot rods [one who is a member of this forum.I also know that Stony of Oddball Kustoms has taken this issue to court and won. If it isn't raining you don't need fenders. I keep a copy of the legislation in my fenderless 32 five window and am prepared to go to court if charged..

knowledge of the law is the best defence you can have, even if it means keeping the documents handy in case of police or mto who dont know the rules, as many make them up as they go since they dont know.  a buddy of mine has a copy of the mto handbook that the public is not suppose to have, he hauls alot and its a pretty handy book to whip out when the ministry guys are making up some bs, they tend to back off pretty quick when they get told the facts from their own book.

Thanks for that Bob T it doesn't take much to get off track. I was told by a couple of cops in Barrie they wouldn't bother pulling fenderless over if it wasn't raining and also mentioned that he knows that most gearheads wouldn't drive them in the rain anyway. However if it was raining it may be another story.

the only problem i have had was getting stuck in the rain and having no choice but to drive it home.  thats why im going with some mini flaps behind each wheel.

Three friends of mine and myself drove across this great country of ours….3 of us NO FENDERS… and across all the provincial jurisdictions, AND through a tornado in Alberta, only one top amongst us. Not a peep out of one cop except "You guys are from Ontario, you gotta be nuts!!!" He didn't realize one of us was from North Carolina.On the way back, Bill and I took #2 from Kalispel, Mt to St. Ignace, Mi. and no one even blinked at no fenders. It's the driving style and attitude you present that'll get you every time

Ditto what Rochie said about attitude. I have been all over the place with no fenders, but I drive respectfully (most of the time).
I also live in a more forgiving area out in the country, but cops will still stick it to ya if you give them a reason. I avoid rain when ever possible.
