While in Pheonix over the christmas holidays I bought a Jag convertible from a high end used car lot,paid for the car and decided to leave it with them until nice weather arrived so I could drive home on route 66.I had them do a few things so I would have a trouble free drive,so when I got here on thursday there were no cars on the lot!!! I was a week to late as the IRS came in and impounded all the cars including mine and 14 others who had their cars in for various repairs because the dealer has been selling cars for cash and not paying taxes,so they say,so it looks like I'm out 25kcry I'm going to spend this week on the blower trying to get my car backfurious wish me luck!

I'm guessing you'll make out OK as long as you didn't pay for the Jag in cash that was delivered in a Crown Royal bag smile


It might not be resolved quickly but I doubt the IRS can confiscate a car that is either in your name or that you have proof of payment for.  It doesn't appear they were selling stolen cars, so there would be no reason (as far as I can see) for the feds to take over ownership of the Jag.  They aren't after you or the Jag, they're after the owners of the business for hiding financial transactions.

Ouch Randy, really sucks hearing that!
There's got to be a way out, I can't see the US gov't punishing innocent people.
I'm thinking they are holding everything that was on the property, until further investigation, if it's your car, you will get it back.

Likely won't be for your planned route 66 trip though.
Again, really sucks hearing this.

That happened to me right here in Ontario. Lost 30K. It wasn't a car but they had my property and I could not get it back. The company just filed for bankruptsy. First the feds take what they are owed. Then the banks take the rest. It was even the same bank I deal with but they didn't give a crap.

Had a customer bounce a check for about $800 bucks . No answer when called many times so went to small claims court.Finally got a day in court .Sat in a row with the guy they ripped for new cupboards,beside him the landscaper,beside him the guy who did the drive way.Court orders repayment ,they say they have no money,lost job welfair yada yada. Guy in suit in another row from the bank say they seized the house for morgague default. I ask him later if I can get my appliances back,guy in suit says everything belongs to the bank and will be sold to recover there money first and if there is anything left it will be devided between the other claiments. Still waiting not holding my breath bin 8yrs . Banks suck and the cheque bouncer was last seen in Portugal evidently skipped probation as well. Ed

... and you never want to sell property and be the one the payments are supposed to come to - let the bank lend them the money
my father had a friend with a body shop / home set up in kingston
(adda's auto body) he sold the property , the buyers knocked down the house and body shop then stoped paying for it ...

he got the title to the land back but it wasn't worth anything near what it had been with working buildings on it

soon after he died .. nice way to finish up , not

a few years before he had a 67 mustang notch back he'd restored stolen off his for sale lot out front one night

a few months later his son , an opp cop saw it sitting in the impound lot .... where it had been since the morning after it was stolen and found a couple of miles up the road so wisdom says if you ever have something cool stolen - go check the impounds yourself - don't count on the cops to tell you they found it - one of em might be wanting it for himself...

good luck deuce, my read is with the receipt you will/should get the car back but how long will it take is anyone's guess. if i remember right arizona has some different rules about cars coming out. while at the b-j auction they were mentioning it a fair bit. being an expensive car it might be in your interest to yak to a lawyer on a consultation basis about the senirio, but i would make sure he resides in arizona. i wouldn't mention a jag or the value, just what if.

Well things did work out great! I really think the owner was set up by the competition down the road but who knows. After a couple weeks of phone calls, meeting with the bank and finely finding my car in a storage yard I found out from the dealers lawyer about a little known law in the US that falls under the consumers rights division and that in layman's terms says anyone that can prove the property was bought and paid for before the foreclosure,bankruptcy or what ever is the actual owner and is not subject to be held by the creditor so I had to send my signed original contract and copy's of the cancelled cheque to prove that it was paid for before all this happened! Me and 14 others lost our cars or money,I was the only one that had all the paperwork right so I got my car the next day.I had my car for about ten days when I talked to some of the others when I stopped in to the dealership and they had been paid back or got the cars they were dealing on,so it goes to show that not all dealers are bad.A few cool sites along route 66,a few detours,and 4700 kms later I'm home and haven't stopped smiling since I left Phoenix and can't wait to turn around and drive across the country again.biggrin

 ed, i have a bud who was in the scale business around here for a long time. also meat slicer's, grinders, patty makers, etc-etc. he had a clause in the bill of sale that stated it remained his property until the the cheque cleared/paid in full. i know over the yrs he would get stuff back even if the doors were locked up. thats going back awhile though.

Put a above ground pool in a guy's back yard years ago, and never got paid. Took him to small claims, and won, but cuz the guy was a handicap, couldn't get any $$$. So being the a$$ wipe that I am, put a lien on his house and waited. About 6 years go by, and I get a call from a lawyer, asking how much $$$ we were owed. Lets see, original cost, legal fees, interest, yada, yada, yada, and came up with the figure. No argument, no nothing - here's the $$$,and please sign this release. Better than money in the bank as far as interest.
