after living here some 22 yrs , I finally decide to pave the lane way . the side towards next property is about 1 ft inside property line , there is a swale there on the property line with a storm drain , basin on our side of the sidewalk out by street.
Just because we know our neighbours are a bit special , last yr I contacted the city , talked to the guy in charge for about an hour . gave him detailed info on what we were gonna do re paving lane way . He says no problem , angle towards the swale an pave away . This yr we had 3 pave co,s come to give estimates . They all said yup angle towards the swale an pave it .
Picked one co , the pave go sign was on frt yard for like 2 1/2 months before they came . First was the excavating crew . they were only here for an 1/2 hour maybe , when the neighbours wife , came over an started asking re , what were they doing , property lines , permits etc etc
How its being done is cause it was gravel , they excavate first , pack it etc , then come back in a few weeks repack , level it an pave it .
I came home at lumch time to see it , the next door lady , comes running over with a piece of paper , with ph numbers on it an a portable ph , telling me how she had to ph the city cause of work being done on our property
Why ??? . its on my side
well you just can,t pave your lane way with out talking to us so we can discuss it
Whats to discuss its a foot onto our property
There,s a swale between our properties
and their property is about a foot higher then ours is

now the sign has been up 2 1/2 months , nothing said till work crew showed up .
every spring , fall heavy rain , winter thaw etc my lane way puddles up , for the 16 some yrs they been living there , never once have they said any thing when I dig a trench across my lane way an drain a 8 ft x 6 ft 4 inch deep and a 6 x 4 ft x 4 inch deep puddle into the swale . not one word

I basically threw them off my property last time I spoke to them , to stay off my place and mind their own business . and found out today they were on my property again today , walking around on my lane and my stooopid security camera didn,t record it
I,m waiting for the city inspector to get in touch with me . I want to meet him on the lane way , and if he says it,s ok ....then I want him to go an tell them , then I,m gonna tell them to f off again , hope fully it sticks this time ..77.

the way i am thinking is there is only one issue involved. each property is responsible for their own run-off. yours or their's cannot run onto each others. i just went through this on a big scale at my commercial building in town. the company beside me went to pave their lot, probably a 1/2 acre, and the run-off was into my vacant 2 acre pc beside them. i went and asked what they thought they were doing and was told it was their business not mine. that didn't go over so well. i contacted the city, belleville, and they come out and have a look and informed them they can't do the paving unless they divert the runoff a good distance to the back of their property into a community ditch. probably tripled the cost for all the extra excavating to get right pitch to the back.
about 7-8 of their employee's parked on my vacant land for as long as i have owned it, 7yrs, but no more. the fence cost me a couple of grand but now we know where we both stand.
if the swale is on their property you could have an issue. if it is yours or 1/2 of it is you should be ok, guessing. get the city in before you pave.
Most municipalities have strict rules for drainage and water flow. Unfortunately, they are seldom enforced until a situation like this comes up. People landscape and continue to add soil until they are drowning their neighbour. By this time it is too late and the inspector is reluctant to enforce. I would be going to municipal standards and forcing them to change their drainage.
the center of the swale an center of catch basin storm drain is right on property line . I called city an had them send a guy over , turns out he was head of that dept . he checked my lot survey from before the city widened my street , the latest survey , measured my lot , checked the property lines , measured lane way , checked the level an drainage etc etc and it cleared 100 %.
even tho my neighbours are royally pi ss ing me off . when he called me before he went to check it . I told him whether I,m right or wrong or what ever changes I need to do , to be compliant or legal , I wanted him to go to neighbours house and tell them what he found , right when he was there . he said ok . I also asked him to be nice as next door wife is like one of those people you seen who have had a nervous break down an never got over it , a bit shaky at times . ( my polite way of saying F , in loopy )
He did , called me back an said all was ok , they have no thing to stand on if they make any further complaints .
When my woman came home from her morning job next door wife came over , knocking on door wanting to talk about the inspector , she just said , talk to my husband an closed the door in her face .
Yesterday 3 days after verbally , loudly telling the two of them to get off my property , stay off an mind there own business . the woman came onto my property an hand delivered a letter to my mail box , one of those oh so polite letters
then today the woman comes home an same letter is in mail box but delivered thru express post .
Like Really ????. People get a life .
Oh well , wait till next yr , when I move my single car garage down to back , and build a 2 car one in its place , the drama never ends ha ha ..77.

to bad bud about the a-hole neighbor. i would be talking to the planning dept about the garage situation before i got into it knowing there is going to be a brew-haw from next door. sorta cutting them off at the pass sort of thing.

More BS from living too close together, no room! Get a nosy neighbour and they can cause all kinds of grief, someone is always arse picking at someone else.

and also on the garage plans I know 3 guys that have just built garages , and this same inspector guy told me , when I decide to do it , to call him , and he will personally come an go over the plans
with me , an give me some tips on what to do
while you might think this is going above an beyond his duties , he said this cause when I told him I was gonna move my present garage an build a new one . first thing he said was , you get water in your garage don,t you an I,m like yea , cause its on a low spot , He,s like yea tru , but half of your water problem is run off from your neighbours property .......

oh yea if you build a shop garage here you are going to need a run off drainage plan report done , and force your neighbours to grade their yard away from yours
I wouldn,t usually say this about a city official , BUT I LIKE this guy . he said 80 % of the calls they get the caller or complainer has no idea what they are talking about .
what I have learned from this an what i should have done as soon as we moved in . Put another 20 grand onto the mtgge , like a 30 bucks a month more in payments . And built a big garage an paved an fenced right offa the bat .
when we move from here , that's how I,m gonna do it at the next property ..77.
