Hang onto you wallet, car owners: the provincial government is coming for us again and it’s going to make driving much more expensive — especially for the poor.

The financial whammy about to come down on us when the budget is delivered next month could be threefold: a new gasoline tax likely disguised as “carbon pricing;” new vehicle registration fees that the province may allow all municipalities to collect; and revised safety standards for used vehicles.

Only the last of the three increases in car ownership costs is a sure thing. Tough new inspection rules for used cars come into effect on July 1 and they are guaranteed to make the cheapest used cars much more expensive to buy.

The government and the new car dealers are touting the tougher rules for used cars as necessary for safety, and perhaps to some extent they are. But I’ve never heard of anyone dying or even being hurt because of the old rules, which were in place for 42 years.

On the other hand, I know of plenty of people who couldn’t get a job because they didn’t have a car. And the tougher inspection rules will put the price of the cheapest used car or truck even further out of the reach of young people and the working poor.

Under the current rules, a technician must inspect the windshield, tires, brakes and mechanical systems of a car (10 different areas of the vehicle) and certify that they are functional within reasonable wear limits.

Under the new rules they will also have to inspect a whole raft of vehicle elements previously overlooked: engine mounts and door latches, fuel lines, airbags, lightbulbs and electronics — including the dash warning lights, which are the bane of car owners everywhere.

You know that pesky engine light that’s been on in your Impala since 2002? No certification for you after July 1. No sale until a dealer fixes it — which as we all know, can be very expensive in the case of an engine light.

Thanks to the abomination called Drive Clean, the days are already long gone when young people and the working poor could pick up a $400 junker to get them to school or the plant cheaply.

Unless someone is giving you a car today, a few thousand bucks is the cheapest you can pick up a reliable used ride these days. The insurance (another terrible government-sponsored racket in Ontario) is likely to cost you more than the vehicle.

The new inspection rules probably won’t change a thing about the prices of used cars offered by dealerships and big used car outfits like Stricklands in Lakeshore, which already check their used cars pretty carefully.

But the rules are likely to add thousands of dollars to the price of the cheapest, oldest used cars on the market, the ones sold out of backyards on Kijiji and by curbsiders.

It will also cut the value of the used car you already drive. “Knock about 25 per cent from the value of your used car on July 1,” warned a knowledgeable poster called KJ_in_Kingston, commenting on an article about the new rules on autotrader.ca.

“There is virtually no need for this … huge money grab and an attempt to force perfectly good vehicles off the road so the automakers and dealers can extort ridiculous amounts from car owners,” he ranted. “More garbage law.”

At a time of declining prosperity, it’s going to cost Ontarians billions more to drive every year, on top of the $10 billion they already pay in taxes and fees. That means more of us will have to walk, ride a bike or take transit against our will.

Those of us lucky to have good jobs will be fine; well, we might have to give up a few drinks or a few nights out. It’s what the new rules and fees will do to families barely scraping by that makes my blood boil.

The proposed vehicle registration fee alone could raise up to $660 million from the owners of the 11 million cars in Ontario, says Frank Notte, director of government relations for the Trillium Automobile Dealer’s Association, which represents Ontario’s 1,000-plus new car dealers.

According to the association higher gas taxes are expected to arrive next month with the 2016 provincial budget.

Premier Kathleen Wynne’s Liberals like to talk a lot about helping the poor — have you heard about their “sharing economy” yet? — but seem to do the opposite when it comes to passing new law.

Justin Trudeau made three promises to Canadians when he was running for office:

  1. Deficits would be no more than $10 billion per year for three years.
  2. He would balance the budget by 2019.
  3. The debt-to-GDP ratio would go down every year.

It’s only been four months since the election, and he’s already broken every single one of those promises.

 

Yesterday the Finance Minister came out and admitted that debt is going up by over $18 billion – and that’s before their upcoming budget spending is counted.

 

We’re already hearing that this Liberal budget could add over $30 billion to the national debt!

 

 

 Justin Trudeau has abandoned all of his promises to manage spending, and is in the process of piling tens of billions of dollars in new debt onto the shoulders of Canadians.

You guys do know the difference between provincel and federal , right. This expense and turmoil that the provincel Liberals are causing is costing us milllions unnecessarily . All these expensive safety blitzes and all this extra certificate B.S. and for what . I checked a few things out about accidents(collisions)and it seams as far as I can see that only about 12% of accidents are actually caused by mechanical failure, this includes load issues with lrge trucks. It seems to be a lot of expense for such a small portion. If they devoted this much attention to road maintance, winter and summer, or crackdown on cellphone use or any of the other things that cause the other 88% of accidents on our roads. Just another example of government bullys picking on us because they can. Ed

The people who put this government into office don't drive cars. No interest in cars and many don't even know how to drive. They are the Google Self Drivers of tomorrow.

The Provincial Liberals have to be the worst government ever and yet the citizens of Ontario gave them a majority. Pile on the Federal Liberals and we are in real trouble folks.

Those who live north of Highway 7 are not represented nor are we cared about. Keep Toronto happy Keep Liberals happy.

That is about 17 cents a US gallon increase but 4 cents a litre sounds so much better thanks to the metric system. If they raised the gas tax in the US 17 cents a gallon............. well just let your imagination run wild what would happen.

I watched a bit of that too.  The part that stood out for me was the "well, it took us 40 years before we were able to determine that smoking is bad for your health" so I figure NOTHING will be done about wind generation and health issues for a good long while yet.

She says the government will use revenue raised from auctions of carbon emissions to industries to keep electricity rates in check.

Wynne says people have to realize the cost of doing nothing to combat climate change will be even greater than putting a price on carbon.

More details of the cap-and-trade plan are expected to be revealed in Thursday's Ontario budget.

It is scheduled to take effect next January and the government expects to raise about $1.3 billion in its first full year of operation, money that will be devoted to lowering greenhouse gas emissions.

        BiG Tobacco Money (read payola) was in all Governments pocket then.If you did not watch it all you missed the best parts. They cannot refuse current studies from other countries, times have changed,we have the technology. I will never forget the one line  Wynne used in her flotiala" I want to say to my grand children Yes we did our part for the environment and global warming",Yeah ragdoll," On the backs of the POOR" they (Liberals) are B A K E D!

You know it is interesting that this conference is mentioned. We started a group called "Our Grandchildren Matter Too…Save Maple Lake" when the Premier said she wanted to leave a clean Ontario for her Grandchildren. Apparently our Grandchildren do not matter so much. The MOECC approved a Waste Disposal Site for human waste right in the middle of 120 homes in Haliburton. The MOECC could not tell us of another site that had even 20 homes in close proximity but we got it in any case. Senior Policy Advisory Colin O'Meara to the Minister of Environment, Glen Murray, said dumping human $hit within 1 kilometer of a lake and 100 yards from a year round river had nothing to do with Global Warming.

Disgusting people running and ruining our lives, Province and Country.

 no sh!t joe. i remember back in the late 70's early 80's the u.s. feds put a tax on gas/diesel fuel to be directed for interstate infrastructure and harmonization of commercial regulations for all states. the uproar was incredible bordering on scary. it went through with the amount scaled back and they needed it for sure. if a state didn't get in line with the new reg's it didn't receive it's share for infrastructure. the amount of $$'s it generated in a short time was staggering due to the volumes. back then every 3rd or 4th bridge you crossed was almost considered unsafe. they put it on when some bridges on the eastern seaboard started falling. then you remembered how many times you had crossed them in the past, lol.

Automobiles classified as vehicles

"Debtors could not avoid lien on motor vehicle, as motor vehicles are not ``household goods'' within the meaning of Bankruptcy Code lien avoidance provision. In re Martinez, Bkrtcy.N.M., 22 B.R. 7, 8." 19A Words and Phrases - Permanent Edition (West) pocket part 94.
Automobiles NOT classified as vehicles
"Automobile purchased for the purpose of transporting buyer to and from his place of
employment was ``consumer goods'' as defined in UCC 9-109." Mallicoat v Volunteer Finance & Loan Corp., 3 UCC Rep Serv 1035; 415 S.W.2d 347 (Tenn. App., 1966).
"The provisions of UCC 2-316 of the Maryland UCC do not apply to sales of consumer goods (a term which includes automobiles, whether new or used, that are bought primarily for personal, family, or household use)." NO Law requires you to record / pledge your private automobile

 

CONCLUSION
Is an automobile always a vehicle (or motor vehicle)? No.
This is a question of fact that turns on the use to which the automobile in question is put (i.e., either personal or commercial). While the presumption of an automobile being a vehicle (or motor vehicle) is created by the owner of said automobile registering same with the state as a vehicle, this presumption may be overcome by an
affirmative defense to the allegation of the automobile being a vehicle, baring any evidence to the contrary indicating commercial use.

Police Code of conduct section 2.11 States there is no power to stop or detain a ”person”

In order to find grounds for a search.

[using the word “person lighty as a “person” is a corporate entity /legal fiction.]

 

3: 10 Before the search takes place the officer
must inform the person (or the owner or person
in charge of the vehicle that is to be searched) of
his or her entitlement to a copy of the record of
the search, including his entitlement to a record of
the search if an application is made within 12
months, if it is wholly impracticable to make a
record at the time. If a record is not made at the
time the person should also be told how a copy
can be obtained (see section 4).The person should
also be given information about police powers to
stop and search and the individual’s rights in these
circumstances.

 

 

 

4.2 A copy of a record made at the time must be
given immediately to the person who has been
searched.The officer must ask for the name,
address and date of birth of the person searched,
but there is no obligation on a person to provide
these details and no power of detention if the
person is unwilling to do so.

 

S.52 of the Consititution covers this:

Criminal acts include acts committed in violation of a citizen's constitutional rights and in violation of guarantees of equal protection of the law (civil rights).
