At 2:45pm today, Premier Clark will announce owners of qualifying specialty cars without mud flaps or fenders can now operate legally thanks to an amendment to the Motor Vehicle Act Regulation.

Ontario highway traffic act [HTA] states "must have fenders to stop roadway splash"!!! Years ago I 'BEAT" the ticket for no fenders, as I stated 'it was not raining, therefore "no roadway splash" Judge threw out the charge!!! So the way I read it, No rain" your OK!!!! Rag Top is right, the "Bitch" at Queens Park, is doing everything she can to destroy the car, our new Provincial safety inspections [96 page long insp.] is meant to take as many vehicles as possible "off the road" & have heard she may bring in annual or "semi" annual inspections within the next yr.& not just for vehicles changing owners as it is now. That will eliminate even more vehicles off the roads in "hopes of "her' plan that we will all buy "GREEN" vehicles!!! I helped her on that one, my 69 Cutlass Rag top is "Green" with black top!!!!!

The fender law in Ontario is basically a fair weather law and actually has been upheld in court many times, just don't try making rooster tails. This mirrors the law in BC which states almost the exact thing so really we had it here first.
Speciality car owners in the province are now legally allowed to drive fenderless cars.
Collector cars without mud flaps or fenders are now allowed to be driven in British Columbia, all because of an amendment to the Motor Vehicle Act Regulation.
Premier Christy Clark made the announcement on July 1.
"Whether they live here or are visiting, owners of these special, modified vehicles can now drive our roads legally," Premier Clark said in a press release.
"These owners take great pride in their cars and this summer, they can take them where they belong - the open road."
Owners of vehicles without mud flaps or mudguards can use their vehicles on dry and paved highways. Cars that are included in this amendment must have been built in 1940 or earlier, or be a replica of that vintage of the vehicle.
Todd Stone, minister of Transportation and Infrastructure said this change will help attract more car shows to the province.
"This is a common-sense fix to unnecessary red tape that was making it difficult to attract collector car events to our province. Now, thousands of owners can travel to events, or simply take their cars for a spin without special consideration or concerns about breaking the law."
Before this change, collector car drivers had to drive their vehicles outside of the regulation, because 1940s-style cars did not have mud flaps or fenders as part of their design.

People think you can't pass, but what it is saying is that it is dangerous to pass, but you still can probably ending up with a ticket. If those ticketed for no fenders take it to court, they generally win unless they were throwing up water or debris.

[I am 70 and have been doing this since 1960. I bought my first Model A and built a rough but sweet street rod. In 1966 I campaigned another C/A Model A Tudor under the "Village Idiot" banner. Shorly after that I built a 1932 Bantam coupe painted by Ken Kay. Was going to drive it to Mexico but marriage got in the way. Bought factory stuff for some years and then in 1987 I bought my 1962 Cutlass with it's great little 215 aluminium V8. I have a saying, 'you can only make it better' and to this end, I have upgraded everything. The engine is a D&D build, 5 speed, 4 wheel disc brakes, recalibrated suspension, dual chambered exhaust, custom cooling system etc. I am now building a 1930 Model A Tudor Hi-boy which I hope to have on the road the Spring of 2014. I live on 2.6 acres on West Lake and just finished a 30x60 garage so this has slowed down the rod building. I love to talk about mine and other's cars on the internet, at cruises or even over the phone. By the way, I found the Bantam body two years ago and it is sitting in pieces in storage waiting for another day. I believe hot rodding is as diverse as the auto world itself and will assist any builder regardless of age or the type of car they drive just like what happened to me back in the early 60’s. The law actually says "road spray" not splash which can mean dust not just water so you can expect a ticket in any weather depending on the police officer's mood. I've talked to the Ministry about this. I'm currently driving my fourth. fenderless car since 1972 and I've had only one ticket so it's not a huge concern.
