When buying commercial property for personal use does one have to pay HST ?

All brand new construction should have HST as there is zero HST paid on all supplies and sub contractors during the build. They claim all the HST they paid back when they remit.

I bought an older unit for commercial use. Since the tenant is generating revenue, I didn't need to pay HST.
Personal use, I believe I would have had to pay it.

CRA gave me the info.
Perhaps give them a call.

Even my real estate lawyer didn't know.

 quick answer, yes, especially if it transfers into your personal name for personal use.  i just went through something similar buying vacant farm land which would of been exempt if i was planning to keep farming the land as an ongoing business.  the lawyer i used in peterborough for the deal said no but my accountant of 25 years, including for 2 audits, here in belleville said yes it had to be paid and i paid it. when i get a move in permit on the house that is going to built i will get somewhere around 60 percent of it back. 

 if you are buying it with the intention of generating income you could defer it but you will need a hst number, be it personal or corporate registered.

 

 on commercial property you might want to check the history on it for owners or tenants who could of been using bad chemicals or etc.  usually no bank will give a mortgage on commercial without some sort of a history or even a environmental phase 1 or 2 study.
